      On March 26, 2024, Exeter Finance LLC (Exeter) received notice regarding a complaint filed through the Better Business Bureau. Exeter would like to thank ****** ******* (*******) for the opportunity to address the concerns outlined in the complaint. Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response.

      Regarding Bullards credit reporting, Exeter is bound by the Fair Credit Reporting Act which requires all accounts to be reported accurately to the ************************* (CRAs). Account information is furnished to the CRAs every month and will reflect the status of the Account at the time of reporting.

      Exeter has received multiple indirect disputes filed through the CRAs on Bullards behalf beginning in October 2023; all disputes were responded to within 30 days. In response to those disputes,Exeters records were reviewed, and the information reported to the CRAs was confirmed to be accurate. As such, Exeter will not honor Bullards request to remove the tradeline from their credit file or cease reporting based on the claims presented in this complaint.

      Any discrepancies between the information reported by Exeter and what is reflected on Bullards credit file will need to be addressed by the CRAs directly as each reporting agency is governed by their own guidelines and procedures.

      Based on Bullards specific request, Exeter has placed a cease-and-desist status on their Account to prevent any future collections calls or communications by Exeter. This will leave ******* responsible to contact Exeter on their own regarding their Account and to make payments. Please note, however, that Exeter may notify ******* in writing of its invocation of specified remedies under the Contract should the need arise in connection with the increasing delinquency on the Account.

      Under separate cover, ******* will receive a copy of their executed Contract and a Statement of Account (SOA) showing all Account activity through March 28,2024. Exeter considers both documents to be a validation of debt. A such, no additional documents will be provided. ******* should note that the Contract and SOA are available at any time by logging into MyAccount.ExeterFinance.com.

      I am writing to file a formal complaint against Exeter Finance LLC for their unverified reporting of a debt on my credit report, which I believe violates the Fair Debt Collection Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA). The company's actions appear to contravene several provisions of the ****** including Section 807(8), which prohibits the use of unfair or unconscionable means to collect any debt, and Section 809(b), which mandates the provision of verification of the debt upon the consumer's written request within 30 days. Additionally, their continued reporting of unverified information to credit reporting agencies may violate Section 807(10) of the ****** which prohibits debt collectors from reporting false or misleading information about a debt. Furthermore, these actions may also violate provisions of the ***** such as Section 611(a)(1)(A), which requires credit reporting agencies to promptly investigate disputed information, and Section 623(a)(8), which mandates accurate reporting by information furnishers. By failing to provide verification of the debt and persisting in reporting unverified information, Exeter Finance LLC is potentially in violation of these consumer protection laws.I also contacted ******** and asked for them to investigate and remove the inaccurate and unverifiable account from my consumer report that they are illegally reporting and I requested specifically the alleged original application bearing my signature. They have not been able to provide such proof.

      On August 24, 2022, ***** signed a Retail Installment Sale Contract - Simple Finance Charge (With Arbitration Provision) (Contract) for the purchase of a vehicle with CarMax (Dealer), which assigned the Contract to Exeter.

      Exeter has an obligation to the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually to the ************************* (CRAs). Account information is furnished to the CRAs every month and will reflect the status of the account at the time of reporting. Exeters records were reviewed, and it has been confirmed that the information reported to the CRAs was accurate. We are unable to substantiate the claims presented in this complaint of any violations by Exeter. Any discrepancies between the information reported by Exeter and what is reflected on Browns credit file will need to be addressed by the CRAs directly, as each reporting agency is governed by their own guidelines and procedures.

      Long story short I have a loan with this company, auto loan since 2021. I have paid 18 payments my principal balance has not moved one ***** literally. What is really going on . Regardless of a payment extension or deferred payments. There should have been some sort of movement in balance. ****** was paid to interest only . This is not acceptable. There hasnt been 100 applied to the principal balance. I called yesterday to make my payment early the rep *** on a recorded line stated if I pay today ****** which is my note amount that ***** would apply to interest and the balance will go to principal. I made the payment with the representative and once payment updated still nothing applied to principal. My due date was March 26 I paid on March 11 . What is the problem. I need an audit done

      for the purchase of a vehicle with Natchez Auto Ventures III, LLC, which was later assigned to Exeter.
      Exeter would like to apologize for the misinformation given by the **************** Representative on
      March 11, 2024, regarding the allocation of payments and any inconvenience this may have caused.
      This is a simple interest Account, as set forth in the Contract, which means interest accrues daily and must
      be collected first out of each payment received. Exeter applies all payments received as follows: first to
      earned and unpaid interest, second to principal, and third to other amounts owed under the Contract (e.g.,
      late fees). Late payments, partial payments, and extensions will impact the amount of interest accruing on
      the outstanding principal balance. Under the portions of the Contract, "Finance Charges and How We Will
      Apply Your Payments" it speaks to simple interest and payment allocation.
      Exeters records were reviewed, and it was determined all payments have been applied to the Account
      accurately. **** will remain liable to Exeter under the Contract, which remains intact until the Account is
      fully satisfied.
      Under a separate cover, **** will receive a copy of their executed Contract, Simple Interest Tool, and a
      Statement of Account showing all Account activity through March 20, 2024. Exeter considers these items
      to be a sufficient validation of the debt. No additional documents will be provided.

      I have a loan with Exeter finance for $21,211.46. That was the original amount of the loan. I agreed to pay at 28% APR however Exeter finance has been charging me a daily interest along with my 28% APR. And all the payments that I have applied since data purchase of August 22, 2022, have not been applied to the principal of the loan in anyway they have reverse multiple payments and then turned around and charged me late fee and I made the payment again. Ive also made extra additional payments towards my loan to help pay it off, and nothing has went towards the principle of the loan and interest only, I have the contract that states its a 28% APR and the amount now I owe more than the original amount of the loan due to their interest daily along with the APR interest rates and all their late fees that they tacked on even when it was never late . They have also dinged my credit really really bad due to missed payments that did not happen.

      On August 8, 2022, ***** signed a Retail Installment Contract - Simple Finance Charge (With Arbitration Provision) (Contract) for the purchase of a vehicle with ***************************************** (Dealer), which assigned the Contract to Exeter.

      Exeter is an indirect automobile lender that purchases retail installment contracts from automobile dealers. We do not communicate or negotiate loan terms with borrowers prior to consummation of the Contract between the borrower and the Dealer. All required information regarding the contract terms including the Annual Percentage Rate were disclosed on the Contract as required by law. The signed Contract shows that all parties agreed with the terms and conditions.

      ***** has a simple interest Account, as set forth in the Contract, which means interest accrues daily and must be collected first out of each payment received. Exeter applies all payments received as follows: first to earned and unpaid interest, second to principal, and third to other amounts owed under the Contract (e.g., late fees). Late payments, partial payments, and extensions will impact the amount of interest accruing on the outstanding principal balance. Exeters records were reviewed, and it was determined that all payments received have been allocated properly to the Account. Additionally, any fees assessed have been charged to the Account in accordance with the terms of the Contract.

      Exeter has an obligation to report its consumers account information in accordance with the guidelines stated in the Fair Credit Reporting Act. The information,including delinquent payments reported to ************************* (CRAs) is accurate. Any discrepancies between the information reported by Exeter and what is reflected on Smiths credit file will need to be addressed by the CRAs directly, as each reporting agency is governed by their own guidelines and procedures. Exeter is unable to substantiate the claim presented in this complaint of any violations by Exeter and will not honor ****** request to remove the valid delinquencies from their credit file based on the claims presented in this complaint.

      Entered into car loan on 9/14/2019 and made final payment 10/2/23. Exeter was to mail a title release form in order for us to go to the *** and get a title on the vehicle. Have made several calls, and emails to try to rectify the situation. Every time I speak with someone they tell me it has been sent and they will resend it and to wait 14 days. Last time I spoke to them was February 16th. They state that they have sent it in my wife's name but she has not received anything either. We have verified address everytime we have spoken with them and still have not received the paperwork in order to obtain the title to a car we paid off five months ago.

      On October 10, 2023, Exeter received the final payment to pay off Dapores account. On October 20, 2023,
      Exeter released the lien on the title electronically to ***** DMV. ****** has an electronic title and ****
      does not automatically issue/print a paper title. ****** must go to the county clerks office to request a lien free paper title. Exeter would like to apologize for the misinformation given by the **************** Representative and any inconvenience this may have caused.

      Date of transaction: Dec 20 2019 Purchased car from local ****** dealership and financed car through EXETER Finance.Total financing of vehicle was $12,883.67 with an interest rate of *****% over a 4 year term loan. All monthly payments were paid and I requested early payoff amount on April 22 2023 and amount given for payoff was $6,064.00. This amount was good for 12 days. On May 1, 2023 I called to payoff car and was told they would need to take the final payoff in 2 separate payments on 2 separate days which I found odd but complied. 2 payments were drafted out of my account starting on May 1st 2023 for $*****.00 followed by a $3,064.00 payment taken on May 2, 2023. I was then told I would receive title in mail with 30 days. I never received title and reached out in August to determine why. It was discovered that they had made a mistake and somehow lost one of the final payments of $*****.00 somehow after I sent them proof of my bank statement showing both final payoff payments Totaling $6.064.00. I spoke with upper management (******) who agreed there was an error on their end and she would personally handle it. Fast fwd to Dec 2023 and I spoke with ****** requesting update. She informed me that it was being handled and to disregard calls I was receiving for payments. On February 28, 2024 at approximately 11pm a tow truck arrived at my house to repossess my car that was paid in full. The tow truck driver rang my doorbell and informed me of his intentions because he thought something wasnt right on his paperwork because it stated there was a zero balance owed on car. He wanted to allow me to get my belongings out of the car prior to taking it out of respect and confusion with paperwork. Called EXETER this morning 2.29.24 and they claim ****** no longer works there and they have no record of the additional ***** paid on May 2nd nor bank statement I sent in proving it was paid. I resent proof of payments and was told it would be Tuesday before I could car.

      On December 11, 2019, ******** signed a Motor Vehicle Retail Installment Sales Contract Simple Finance Charge (With Arbitration Provision) (Contract) for the purchase of a vehicle with *************** (Dealer), which assigned the Contract to Exeter.

      Exeters records were reviewed, and it was determined that, on May 1, 2023, a payment in the amount of $3,000.00 was processed on the account. ******** requested for the **************** Representative (***) to call back within an hour to process the second payment. The *** placed a call back to ******** and was directed to her voicemail. Subsequently, the remaining payment was not processed on the account. As a result, the account remained opened with a balance.

      On October 30, 2023, a Notice of Intent to Accelerate was sent to the address on file requesting the past due balance by November 12, 2023. On November 15,2023, a Notice of Acceleration was sent to the address on file advising the total amount is due now and failure to pay will result in the repossession of the collateral.

      On February 28, 2024, Exeter recovered the collateral due to nonpayment.

      Exeter has requested ********* rolling bank statements several times throughout the months leading to the repossession. ******** has not produced the rolling bank statements that meet the requirements to receive Exeters approval to complete the dispute process. Exeter is unable to substantiate the claims presented in this complaint.

      Dear Better Business Bureau,I am writing to bring to your attention a concerning issue I have encountered with Exeter Finance, regarding the repair of my vehicle following an accident on November 22, 2023. I believe that the practices of Exeter Finance have led to an unjust and frustrating situation for me as a customer.Following the accident, I initiated a claim through my insurance company, resulting in a check being issued with both my name and Exeter Finance's name on it, as they are the financing company involved. Upon endorsing the check and sending it to Exeter Finance as per their requirements, I was informed that their policy dictates that all repairs must be completed before the funds can be released to the body shop directly. This policy, however, is not standard practice among body shops, including the dealership.Furthermore, Exeter Finance has imposed a strict 60-day deadline for me to find a body shop that adheres to their policy, failing which the funds will be allocated towards my principal with no alternative options provided. Despite my diligent search for a suitable body shop within a 50-square mile radius, I have been unable to find one that meets Exeter Finance's criteria. As a result, my vehicle remains unrepaired, rendering it undriveable, while I continue to bear the financial burden of my $800 monthly payments.I find this situation to be unreasonable and unjust, as it effectively leaves me without a viable solution for repairing my vehicle within the constraints imposed by Exeter Finance. When I sought a recommendation for a compliant body shop, I was met with indifference and informed that the responsibility lies solely with me to locate one.I am deeply dissatisfied with the lack of flexibility and assistance provided by Exeter Finance in this matter, and I urge the Better Business Bureau to investigate this issue and advocate for a fair resolution that considers the practical challenges faced by customers in similar situations.

      Exeter acknowledges Beverlys efforts to keep their account in good standing while the vehicle is inoperable. While Exeter empathizes with ******* and the difficulties that are presented with locating a repair shop within their area, Exeter must adhere to our policy in order to ensure the value of the collateral is restored. 

      Regarding Beverlys vehicle, which is also considered Exeters collateral, once it is considered damaged, the applicable insurance company will issue a repair check made payable to Exeter and the borrower. The funds from this check belong to the repair shop if repairs are made. When the insurance repair check is received by Exeter, the insurance repair check will be processed. When the vehicle is repaired and acceptable evidence of repairs is furnished and validated by Exeter, the funds to pay for repairs to the body shop will be processed and sent to the repair shop.

      Additionally,this is to confirm, if repairs are not completed by the 60th day of Exeter receiving the check,  Exeter will apply the check to the principal balance of the account. The check can be reallocated from the principal balance at any time to pay the body shop once all the required documents are received. Please know, ******* does have the option to pay for the repairs out of pocket, and upon receipt of the repair bill and proof of payment, the insurance repair check funds will be reissued to *******.

      Exeter Finance Company mistreats my account, which frustrates me. Exorbitant interest rates and incompetence in financial procedures have ruined my experience with your company. Exeter Finance has high-interest rates, burdening clients like me. The interest has been excessive, making it hard to pay off my sum despite my efforts. My latest automobile payoff mismanagement is appalling. I mailed my certified check on January 26, 2024. My check was received. The 29% interest rate on my company loan had to go. On January 30, 2024, I received Exeter Finance's letter to approve and return disappointed me. This would be fine if it were my bank's check. I told them about the other customer's cheque and money loss. On January 31, 2024, I informed them of the mix-up and asked what to do with the other customer check. Again, I was told that I should mail it untracked. Unfortunately, Exeter Finance sent me someone else's check to endorse, breaking privacy and security rules. After submitting this gross error to your organization, I was told my complaint would go to management. Within 72 hours, I was to phone for an update. I followed up within the specified window but found no resolution status. This lack of accountability and transparency is problematic, considering the urgency. Exeter Finance. The long wait worries me since I need to know where my check is. After being called back, I was told to stop payment on the missing check and request a new one. Another customer checks, and I hold. I'll pay to return it. The other clients' checks and my reissued bank check. In the January 25, 2024, payout call, I said I would charge $11,832.67. I discussed this topic with the following people. Call after January 31, February 20, 24 2024. I spoke with supervisors and customer service. *************************, ******, Aquella, *****. We record all calls, says this company. On the last February call, I suggested they analyze the calls to see what their colleagues did and didn't do.

      I have a issue with a "exter finance" being reported on my experian credit report only. This account does not show up on transunion or Equifax credit report. Exeter has not sent any original contract I also have a u.c.c 11 from the ******** secretary of state that says there is no debit in my name past or present I have uploaded a copy of my most recent transunion credit report to show that according to 15 usc 1692b that this has not been reported accurately. I have also tried to opt out of this being reported on my Experian credit report via 16 cfr ***** 16 cfr ***** as well as 15 usc 6801 - 6805 and have been unsuccessful what I ask is that you all verify this account and find out why it's only being reported on my experian credit report only and have the account removed from my experian credit report

      Exeter has an obligation to the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually to the ************************* (CRAs). Account information is furnished to the CRAs every month and will reflect the status of the account at the time of reporting. Exeters records were reviewed, and it has been confirmed that the information reported to the CRAs was accurate. Any discrepancies between the information reported by Exeter and what is reflected on Tankersleys credit file will need to be addressed by the CRAs directly, as each reporting agency is governed by their own guidelines and procedures.
      As of August 22, 2023, the account was sold to NCB ************************* (NCB). The account was reported to the CRAs as sold and was closed by Exeter with a zero balance. Exeter does not delete tradelines on accounts that are sold, paid, or settled in full. Exeter is unable to act with respect to this account regarding any matters that occurred after the sale of this debt.
